ARTICLE 13. MEDIATION – APPLICABLE LAW AND JURISDICTION

In accordance with the articles L. 612-1 et seq. of the Consumer Code, the Client has the possibility, as a consumer, to have free recourse to the Consumer Mediator at the Conseil National des Barreaux (CNB), whose contact details are as follows:

The Client’s attention is also drawn to the fact that the dispute over fees is subject to a specific procedure provided for in articles 174 et seq. of Decree No. 91-1197 of November 27, 1991 on the organization of the legal profession, in first instance before the President of the Bar of the Court of Appeal of Paris and on appeal before the Court of Appeal of Paris.
In the event of a dispute, the amount of fees, costs and disbursements calculated in accordance with the Contract and still owed to Blue Bridge Law SLP must be deposited with the President of the Bar of the Court of Appeal of Paris pending the final decision on the setting of fees, costs and disbursements.
Similarly, any dispute with Blue Bridge Law SLP, if it cannot be settled amicably, must be brought before the President of the Paris Bar.
If the main service’s destination is Spain:
In the event of a dispute relating to the interpretation or application of these general terms of engagement, the Client agrees to settle their disputes through mediation at the ICAM (ICAM Mediation Center).
If the Client and Blue Bridge Law SLP are unable to resolve their dispute through mediation, they agree that any dispute relating to this contract shall be submitted to the arbitration of the Arbitration Tribunal of the Madrid Bar Association, in accordance with its statutes and rules of procedure. The Client is informed that the mediator may only be seized after having attempted to resolve the dispute directly with Blue Bridge Law SLP through a written claim.
In accordance with the General Data Protection Regulation (GDPR) and Organic Law No. 3/2018 of December 5 on the protection of data and the guarantee of digital rights, it is emphasized that the processing of the client’s personal data is confidential and strictly necessary for the provision of the services agreed between the parties.
Purposes, legal bases, and retention periods for data processing:
1. Contact form and appointment booking: processing of your name, email address, telephone number, and message content. Legal basis: your consent (Article 6(1)(a) GDPR) and pre-contractual measures (Article 6(1)(b) GDPR). Retention period: 3 years from last contact, then deleted.
2. Client file management: processing of identification data, case-related documents, and financial data for invoicing. Legal basis: performance of a contract (Article 6(1)(b) GDPR) and compliance with legal obligations (Article 6(1)(c) GDPR). Retention period: 5 years after closure of the matter, in compliance with professional and fiscal obligations.
3. Website analytics (cookies): processing of anonymized browsing data (pages visited, session duration). Legal basis: legitimate interest (Article 6(1)(f) GDPR). Retention period: 13 months maximum, in compliance with CNIL guidelines.
4. Newsletter (if applicable): processing of email address. Legal basis: your consent (Article 6(1)(a) GDPR). Retention period: until withdrawal of consent.
For legitimate reasons, clients may object to the processing of their data and have the right to access, limit, rectify, delete or erase their personal data.
